5.) Return / Refund Policy -

• Should the customer for any valid reason wish to cancel the order from the supplier, the supplier will still be responsible for the Network fee. The supplier must advise Link2suppliers.com in writing of the cancellation and any such cancellation must be signed by the customer who made the order.

6.) DELIVERY POLICY, OPTIONS, COSTS AND TIMES -

• Link2suppliers.com do not handle any deliveries on any parties behalf. It is solely the responsibility of the supplier to do so, or as otherwise agreed in the transaction.

7.) COOKIE/TRACKING TECHNOLOGY -

• The Link2suppliers.com Network relies heavily on cookies, small bits of information which are saved by your browser and are used by the Network to identify you.
  • Personal information cannot be collected via cookies and other tracking technology however, if you previously provided personally identifiable information, cookies may be tied to such information.

9.) DESCRIPTION OF SERVICE -

• Link2suppliers.com is only a facilitator and provides users with a platform to request Price and Availability the device now known as (the "Network").

• You also understand and agree that the Network Service may include advertisements and that these advertisements are necessary for Link2suppliers.com to provide the Network. You also understand and agree that the Network may include certain communications from Link2suppliers.com, such as service announcements, administrative messages and the Link2suppliers.com news Letter, and that these communications are considered part of Link2suppliers.com membership and you will not be able to opt out of receiving them. Unless explicitly stated otherwise, any new features that augment or enhance the current Network Service, including the release of new Link2suppliers.com modules and services.

• You understand and agree that the Network Service is provided "AS-IS" and that Link2suppliers.com assumes no responsibility for the timeliness, deletion, mis-delivery or failure to system any user personalisation settings. You are responsible for obtaining access to the Network Service and that access may involve third party fees (such as Internet service provider or airtime charges). You are responsible for those fees. In addition, you must provide and are responsible for all equipment necessary to access the Link2suppliers.com Network Service.

• You must be a company or a registered business to register, make use of any modules on the Network or to place orders.

10.) YOUR REGISTRATION OBLIGATIONS -

• In consideration of your use of the Network Service, you represent that you are a legal business to form a binding contract and are not a business barred from receiving services under the laws of the Republic of South Africa or other applicable jurisdiction.

You also agree to:

• provide true, accurate, current and complete information about yourself as prompted by the Network Service's registration form (such information being the "Customer Registration Form") and

• maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Link2suppliers.com has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Link2suppliers.com has the right to suspend or terminate your account and refuse any and all current or future use of the Network Service (or any portion thereof). Link2suppliers.com is concerned about the safety and privacy of all its users.
• Suppliers also agree not to trade or creating profiles with stolen item. The Network strongly condemn any such practices.

11.) MEMBER ACCOUNT, PASSWORD AND SECURITY -

• You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account.
  
  You agree to:
  • immediately notify Link2suppliers.com at ( webmaster@link2suppliers.com ) of any unauthorized use of your password or account or any other breach of security, and
  • ensure that you exit from your account at the end of each session. Link2suppliers.com cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.

12.) MEMBER CONDUCT -

• You understand that all information, data, text, photographs, graphics, messages or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. You (Customer or Supplier) agree to not use the Network Service to:

• disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other users of the Network Service are able to type, or otherwise act in a manner that negatively affects other users' ability to engage in real time exchanges.
• interfere with or disrupt the Network Service or servers or networks connected to the Network Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Network Service.
• provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the UN or South Africa government as a foreign terrorist organization.
• "stalk" or otherwise harass another and/or
• collect or system personal data about other users in connection with the prohibited conduct and activities set forth in paragraphs above.

• You acknowledge that Link2suppliers.com may or may not prescreen Content, but that Link2suppliers.com and its designees shall have the right (but not the obligation) in their sole discretion to prescreen, refuse, or move any Content that is available via the Network Service. Without limiting the foregoing, Link2suppliers.com and its designees shall have the right to remove any Content that violates the AGREEMENT or is otherwise objectionable.

15.) NO RESALE OF SERVICE -

• You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any personal or commercial purposes, any portion (Content) of the Network Service (including your Link2suppliers.com User Name & Passsword), use of the Network Service, or access to the Network Service.

16.) USE AND STORAGE -

• You agree that Link2suppliers.com has no responsibility or liability for the deletion or failure to system any communications or other Content maintained or transmitted by the Network Service. You acknowledge that Link2suppliers.com reserves the right to log off accounts that are inactive for an extended period of time.

• You further acknowledge that Link2suppliers.com reserves the right to modify these general practices and limits from time to time.

17.) TERMINATION -

• You agree that Link2suppliers.com may, under certain circumstances and without prior notice, immediately terminate your Link2suppliers.com account, any associated information, and access to the Network Service.

• Cause for such termination shall include, but not be limited to,
  • breaches or violations of the AGREEMENT or other incorporated agreements or guidelines,
  • requests by law enforcement or other government agencies,
  • a request by you (self-initiated account deletions),
  • discontinuance or material modification to the Network Service (or any part thereof),
  • unexpected technical or security issues or problems,
  • extended periods of inactivity,
  • you have engaged in fraudulent or illegal activities, and/or
  • nonpayment of any fees owed by you in connection with the Services.
  • removal of access to all offerings within the Network Service, including but not limited to Link2suppliers.com Auctions, Holiday Units and/or any product information,
  • deletion of your password and all related information, files and content associated with or inside your account (or any part thereof), and

  • barring further use of the Network Service.

• Further, you agree that all termination's for cause shall be made in Link2suppliers.com sole discretion and that Link2suppliers.com shall not be liable to you or any third-party for any termination of your account, any associated e-mail address, or access to the Network Service.

18.) MODIFICATIONS TO SERVICE -

• Link2suppliers.com reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Network Service (or any part thereof) with or without notice. You agree that Link2suppliers.com shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Network Service.

19.) DEALINGS WITH ADVERTISERS -

• Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Network Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser.

• You agree that Link2suppliers.com shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Network Service.

• You further acknowledge and agree that Link2suppliers.com shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

22.) DISCLAIMER OF WARRANTIES -

  • THE SERVICE WILL MEET YOUR REQUIREMENTS,
  • THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE,

  • ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

• YOU EXPRESSLY UNDERSTAND AND AGREE THAT LINK2SUPPLIERS.COM SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF LINK2SUPPLIERS.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM:
  • THE USE OR THE INABILITY TO USE THE SERVICE
  • THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA
  • STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE OR
  • ANY OTHER MATTER RELATING TO THE SERVICE.

24.) FINANCIAL MATTERS -

• Link2suppliers.com shall not be responsible or liable for the accuracy, usefulness or availability of any information transmitted or made available via the Network Service.

25.) NO THIRD PARTY BENEFICIARIES -

• You agree that, except as otherwise expressly provided in this AGREEMENT, there shall be no third party beneficiaries to this Agreement.

26.) NOTICE -

• Link2suppliers.com may provide you with notices, including those regarding changes to the AGREEMENT, by either e-mail, regular mail, or postings on the Network Service.

Entire Agreement:
The AGREEMENT constitutes the entire agreement between you and Link2suppliers.com and governs your use of the Network Service, superseding any prior agreements between you and Link2suppliers.com with respect to the Network Service. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other Link2suppliers.com services, system country branch services or third-party content.

Choice of Law and Forum:
The AGREEMENT and the relationship between you and Link2suppliers.com shall be governed by the laws of South Africa. You and Link2suppliers.com agree to submit to the personal and exclusive jurisdiction of the courts located within South Africa. Agreement to use the Link2suppliers.com website and those governing all transactions that may be effected using the Link2suppliers.com website shall be deemed to have taken place in Johannesburg, Kempton Park, Gauteng.

Waiver and Severability of Terms:
The failure of Link2suppliers.com to exercise or enforce any right or provision of the AGREEMENT shall not constitute a waiver of such right or provision. If any provision of the AGREEMENT is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties intentions as reflected in the provision, and the other provisions of the AGREEMENT remain in full force and effect.

No Right of Survivorship and Non-Transferability:
You agree that your Link2suppliers.com account is nontransferable and any rights to your Link2suppliers.com ID or contents within your account terminate upon your death. Upon receipt of a copy of a death certificate, your account may be terminated and all contents therein permanently deleted.

Statute of Limitations:
You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Network Service or the AGREEMENT must be filed within one (1) year after such claim or cause of action arose or be forever barred.

27.) INVITATION TO DO BUSINESS -

• The products or services which appear on the Link2suppliers.com website are displayed as an invitation to do business and to allow you to make an offer to purchase the products or services to Link2suppliers.com. Only when the Customer has accepted your offer and the acceptance is communicated to you, will an enforceable agreement of sale be transacted.

• The price of any products or services sold through Link2suppliers.com shall be confirmed on the acceptance of your order. The supplier is responsible for any pricing on there own goods.

• IMPORTANT: If any products or services are supplied and delivered to you directly by, or through, a third party, even though access to the products and services is gained through the Link2suppliers.com website, the supply of these products and services may be subject to conditions which differ from those governing the terms of trade with Link2suppliers.com.

• You shall be solely responsible for ensuring that you understand and agree to the terms and conditions governing the sale of these products and services.

28.) REGISTRATION -
